Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the MomoSI iPhone application and the website at momoai.tech (the “Service”), operated by Collabrains (“we”, “us”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
MomoSI provides AI-assisted photo and video templates and related features on iPhone. Features, templates, models, credit costs, and availability may change. Generation quality and speed depend on your inputs, third-party model providers, device, and network conditions.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) and able to form a binding contract. You are responsible for compliance with local laws when using the Service.
3. Account (Sign in with Apple)
Some features, including generation, may require Sign in with Apple. You are responsible for activity under your account. You may delete your MomoSI account from the Profile screen; deletion removes your server-side account and credit balance. Apple ID management remains with Apple.
4. Your content & license
- You retain rights to the media and prompts you submit (“User Content”).
- You grant us a limited, worldwide, non-exclusive license to host, process, transmit, and display User Content solely to operate the Service and produce the outputs you request (including through our generation providers).
- You represent that you have all rights needed to upload User Content and that it does not violate law or third-party rights.
- You are solely responsible for how you use, share, or commercialize outputs.
5. Acceptable use
You agree not to:
- Upload illegal, infringing, exploitative, or abusive content.
- Use the Service to harm, harass, deceive, or impersonate others.
- Attempt unauthorized access, reverse engineer, scrape, or overload the Service.
- Circumvent credit, rate, or authentication limits.
- Misrepresent outputs as unaltered photographs of real events when that would be misleading in context, where applicable law requires disclosure.
We may suspend or terminate access for violations or to protect the Service and other users.
6. Subscriptions, credits & billing
- Optional Pro subscriptions and any paid items are sold by Apple through the App Store. Payment, renewals, and refunds are governed by Apple’s terms and policies.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period in your Apple ID settings.
- Credits (when enabled) are a limited license to use generation features within the app. Credits have no cash value, are not transferable, and may expire or change if we revise the economy. Unused credits are not refundable except where required by law or Apple’s refund process.
- Prices may vary by region and are shown in the App Store before purchase.
7. Intellectual property
The Service, including templates, branding, software, and design (excluding User Content and third-party models), is owned by Collabrains or its licensors. These Terms do not grant you rights to our trademarks or code except as needed to use the app.
8. Third-party services
Generation may rely on third-party model hosts. Apple provides Sign in with Apple and App Store commerce. Their terms and privacy policies apply to their services. We are not responsible for outages or changes by those providers.
9. Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI OUTPUTS MAY BE INACCURATE, DELAYED, MODERATED, OR UNAVAILABLE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLLABRAINS AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.
11. Indemnity
You agree to defend and indemnify Collabrains against claims arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law.
12. Changes & termination
We may modify the Service or these Terms. Material changes will be reflected by updating the “Last updated” date at https://momoai.tech/terms. Continued use after changes constitutes acceptance. We may discontinue the Service or your access at any time for operational, legal, or abuse-related reasons.
13. Governing law
These Terms are governed by the laws of Türkiye, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply. Courts in İstanbul, Türkiye shall have non-exclusive jurisdiction, subject to those mandatory protections.
